1. Acceptance of Terms

By accessing and using the Addictive Design customer portal and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Addictive Design provides the following services through our customer portal:

• AI Chatbot Solutions for customer service automation
• Social Media Management including content creation and scheduling
• SEO Optimization services
• Customer support and analytics

3. User Accounts

To access our services, you must create an account. You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

Passwords are stored securely using industry-standard hashing. We never store plain-text passwords.

4. Payment Terms

Our services are provided on a subscription basis. Payment terms include:

• All purchases are final and non-refundable, except where required by law
• Subscriptions are billed automatically according to your chosen plan
• All prices are exclusive of applicable taxes (HST will be added where required)
• We use Stripe, Inc. as our payment processor. We do not store or have access to your credit card details. Stripe processes payment data in accordance with its Privacy Policy.
• Cancellation policies differ by service type:
• Chatbot subscriptions: Cancellation takes effect at the end of the current billing period
• All other subscription types: Minimum 60-day notice period is required
• Some subscription types may require longer notice periods based on service complexity
• Cancellations must be requested through the account settings or by contacting support
• You will be billed for services during the applicable notice period
• No refunds will be provided for the remaining time on your subscription
• Failure to pay may result in service suspension or termination
• Prices may change with 30 days notice to existing customers

5. Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Use our services for spam or malicious activities

6. Intellectual Property

All content, features, and functionality of our services are owned by Addictive Design and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Service Availability

We strive to maintain service availability but cannot guarantee uninterrupted access. We may suspend or terminate services for maintenance, updates, or violations of these terms. We are not liable for any downtime or service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Addictive Design shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you paid for services in the 12 months preceding the claim.

10. Termination

For account terminations and most subscription cancellations, different notice periods apply depending on the service type:

• Chatbot subscriptions: Cancellation takes effect at the end of the current billing period
• Social Media, SEO, and other services: A minimum 60-day notice period is required

You may request termination through your account settings or by contacting support. During the applicable notice period:

• Your account will remain active
• You will continue to be billed according to your subscription terms
• You will have full access to all services
• Your final billing date will be confirmed when you submit your termination request
• The exact notice period applicable to your account will be communicated upon submission of your termination request

Account Deletion Timing: Your account and all associated data (including subscriptions, billing history, and service data) will be permanently deleted at the end of the 60-day notice period. During this time, you will continue to have access to services until the applicable cancellation date.

Irreversible Action: Once your account is deleted after the notice period, this action cannot be undone. We will be unable to recover any of your data, content, or account information after deletion is complete.

After the applicable notice period ends, your access to services will cease, and your account and data will be permanently deleted. Provisions regarding intellectual property, limitation of liability, and governing law shall survive termination.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through our service. Continued use of our services after changes constitutes acceptance of the modified terms.

12. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ontario.

13. Force Majeure

Addictive Design shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, civil unrest, government action, internet disturbances, or service interruptions from third-party providers. In the event of such delay or failure, your obligations shall be suspended for a period equal to the delay or as otherwise deemed appropriate by Addictive Design.
